These terms set the rules for using Budget Kicker and explain where responsibility sits between the platform and the user.

The goal is to run a fair, useful service without pretending software can remove all risk from budgeting, billing, or financial administration.

Using Budget Kicker means agreeing to a practical set of rules

Budget Kicker is built to help users manage budgets, invoices, records, and related workflows more clearly. It is still software, not a substitute for professional judgment, legal compliance, or human review.

Important baseline

These terms are meant to be read in plain language. They do not remove rights that cannot legally be excluded under applicable law, including mandatory consumer protections where those rules apply.

1. Who these terms apply to

By creating an account, clicking to accept the terms, or using Budget Kicker, you agree to these Terms of Service. If you use the service on behalf of a business, team, or other organisation, you confirm that you have authority to bind that organisation to these terms.

2. What the service is, and what it is not

Budget Kicker is a software platform for budgeting, billing, invoicing, profile-based reporting, customer records, and related administrative workflows. It is not an accounting firm, law firm, tax adviser, fiduciary, bank, payment institution, or financial advisory service.

3. Eligibility and account security

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for safeguarding your password, login methods, and any two-factor access tied to your account.
  • You must notify us promptly if you believe your account or profile access has been compromised.

4. Your data and your responsibility

  • You are responsible for the legality, accuracy, completeness, and appropriateness of the data you enter, upload, send, or store through the service.
  • You should review invoices, customer details, payment records, dates, totals, tax treatment, and reports before relying on them or sending them to others.
  • You should keep your own backup or export practices where the data is important to your personal, tax, legal, or business operations.

5. Acceptable use

  • You may not use Budget Kicker for unlawful, fraudulent, deceptive, abusive, or rights-infringing activity.
  • You may not interfere with the platform, probe it maliciously, scrape it in an abusive way, bypass access restrictions, or attempt to exploit other users or profiles.
  • We may suspend, restrict, or terminate access where reasonably necessary for security, abuse prevention, fraud concerns, legal compliance, or protection of the service and its users.

6. Teams, sharing, and profile access

If you invite others into a business profile, team workspace, or shared personal budget, you are responsible for making that access decision. Shared users may be able to view, edit, export, or otherwise act on the data available within the permissions and workflows the platform supports at that time.

7. Service availability, updates, and beta reality

  • The service may change over time. Features may be added, removed, refined, renamed, paused, or discontinued.
  • We do not guarantee uninterrupted availability, perfect uptime, permanent feature continuity, or operation free from bugs, delays, or compatibility issues.
  • Some parts of the platform may still be evolving. You should not assume that every workflow is production-perfect for every accounting, legal, tax, or regional business use case.

8. Third-party services

Some functions may rely on third-party services, infrastructure, authentication providers, analytics, CAPTCHA tools, or communication providers. Their availability and policies can affect how parts of the service behave. We are not responsible for third-party services beyond the level of responsibility that cannot legally be excluded.

9. Intellectual property and feedback

We retain all rights in the platform itself, including its software, branding, interface, and original platform materials. You retain rights in the content you submit, but you grant us the limited rights needed to host, process, copy, transmit, and display that content for the purpose of operating, securing, maintaining, and improving the service. If you submit product feedback, we may use it without restriction or compensation.

10. Paid features and subscriptions

If paid plans, templates, subscriptions, or other chargeable features are offered, the applicable price, billing cycle, and plan scope shown at checkout or in the product flow form part of your agreement with us. Except where mandatory law requires otherwise, fees already paid are not refundable simply because a feature changes, a user no longer needs the service, or the service does not fit a particular business model.

11. Account deletion and retention

You may request account deletion through the tools made available by the service. We may keep certain information for as long as reasonably necessary to meet legal obligations, resolve disputes, maintain security records, prevent fraud, enforce agreements, or preserve the integrity of financial and operational history where retention is justified. How data is handled is also described in the Privacy Policy.

12. No professional advice

Any dashboards, calculations, labels, reports, due dates, reminders, templates, summaries, or invoice outputs generated by the service are for software workflow purposes only. They are not legal, tax, accounting, audit, compliance, or investment advice, and they do not replace a qualified professional review.

13. Liability boundaries

To the maximum extent permitted by law, Budget Kicker is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, revenue, business opportunity, goodwill, expected savings, or data corruption arising from use of the service. To the maximum extent permitted by law, our total aggregate liability for claims arising out of or relating to the service will not exceed the greater of (a) the amount you paid us for the relevant service in the 12 months before the event giving rise to the claim, or (b) EUR 100. Nothing in these terms limits liability that cannot legally be excluded or limited, including liability for fraud, wilful misconduct, or mandatory consumer rights where applicable.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless against third-party claims, losses, damages, and reasonable costs that arise from your unlawful use of the service, your infringement of another person's rights, your submitted content, or your breach of these terms. This section does not apply more broadly than the law allows.

15. Termination

You may stop using the service at any time. We may suspend or terminate access, with or without notice where reasonable, if we believe you breached these terms, created material risk, used the platform unlawfully, or continued behaviour that threatens the service, other users, or legal compliance.

16. Changes to these terms

We may update these terms from time to time. If the changes are material, we may provide a more visible notice in the product or on the website. The latest published version will apply from its stated effective date. Continued use after an update takes effect means you accept the revised terms.

17. Governing law and disputes

These terms are governed by the laws of the Netherlands, except to the extent mandatory law in your place of residence gives you rights that cannot be waived. If you are a business user, disputes should be brought before the competent courts in the Netherlands unless another mandatory rule applies. If you are a consumer, nothing in this section is meant to remove any mandatory right to bring a claim in the forum available to you under applicable law.

Final note and effective date

Budget Kicker is currently operated as an independent service without a general contractual support commitment, service desk, or negotiated legal help unless explicitly agreed in writing.
